Notarial Definitions

Notary Public: an individual commissioned to perform a notarial act by the secretary of state.

Non-commissioned notarial officer: a judge, court clerk, deputy court clerk, county clerk, deputy county

clerk, or an attorney licensed to practice law in the State of New Mexico.

Official stamp: a physical image affixed to a tangible record with the capability of being photocopied or

electronic image attached to an electronic record;

Notarial act: an act performed by a notarial officer; taking an acknowledgement, administering an oath or

affirmation, taking a verification on oath or affirmation, witnessing, or attesting a signature, certifying or

attesting a copy and noting a protest of a negotiable instrument;

Remote online notarization (RON): an electronic record presented for notarization with the individual

signing the record and the notary public meet face-to-face online using communication technology
